The Dive Shack Terms
When you purchase a ‘The Dive Shack’ experience and tick the box that says ‘I understand and accept the Terms and Conditions’, you become legally bound by these terms and conditions. Please do not proceed to purchase your experience until you have read, understood and accepted these terms and conditions. COURSES
Participants must be a minimum of 10* years of age to learn to dive in Australia. The participant must be able to swim 200m and tread water for 10 minutes unassisted to learn to dive in Australia. The participant must complete all course theory including exams (Course manual/text books or eLearning) PRIOR to commencement of your course. Failure to complete theory prior to course commencement will result in removal from the course and a rebooking fee relevant to the course.

MEDICALLY FIT TO DIVE
You must be medically fit to dive and sign a Medical Statement declaration (follow the link for further information www.thediveshack.com.au/diving/padi-dive-courses/open-water-diver/dive-medicals/). Please answer the questions on your past or present medical history with a YES or NO and return to The Dive Shack 7 days prior to your course. A copy of the Dive Medical Statement is attached with your booking confirmation and is also available by following the link above. You WILL be required to obtain a diving medical if your medical history deems it.

AVAILABILITY
All experiences are offered subject to availability. Should you would like to book during peak times (such as weekends or holidays), it is recommended to book further in advance. Experiences offered are dependent on minimum numbers. If minimum numbers are not reached an alternate date will be offered for your experience. Please be advised that some experiences display availability dates on the website. These dates are guidelines only and are subject to change. We suggest if you plan to purchase an experience for a date listed at short notice, you contact us to ensure there is still availability before completing the transaction.

Should The Dive Shack need to cancel an experience for any reason, you will be notified as soon as possible in order to reschedule a convenient alternate date. The Dive Shack will not reimburse any travelling, accommodation or other expenses incurred by you or any other person in the event of a cancellation.

RESTRICTIONS
Certain experiences provided by The Dive Shack are subject to minimum age, health or other restrictions. These restrictions are outlined on the relevant course information page and also in the email of your booking confirmation. Please read this information carefully. It is your responsibility to understand any restrictions prior to confirming your booking. If you are later forced to cancel due to restrictions, you may be liable for charges to The Dive Shack. If you are completing a course and are under the age of 18 years you MUST have a parent or guardian sign all medical, course liability and course instruction forms before commencement.

Please ensure that you allow for your pre-flight surface interval requirements to safely fly after diving. Flying after diving recommendations for dives within the No-Decompression Limits; Single Dives: A minimum pre-flight surface interval of 12 hours is suggested. Repetitive Dives and/or Multi-Day Dives: A minimum pre-flight surface interval of 18 hours is suggested. For Dives requiring decompression stops: A minimum pre-flight surface interval of greater than 18 hours is suggested. Source PADI 2013

PADI Open Water Dive Course – Learn to Dive Terms
Be minimum of 10* years of age to learn to dive.
Be able to swim 200m and tread water for 10 minutes unassisted to learn to dive in Australia.
Complete your PADI eLearning and online exam before you arrive at The Dive Shack.
Be medically fit to dive. If you answer YES to any questions on the medical statement, you MUST have a Doctor deem you FIT TO DIVE before your course commencement.

REBOOKING POLICY:

Any booking changes within 5 working days prior to the course
commencement will incur a $200.00 administration fee. Any cancellations made
less than 48 hours prior will be charged the full course price. No refunds are
payable on any course not completed inside 12 months.

Refund Policy (Course Bookings)

Refunds will only be offered in instances where a student has been deemed permanently medically unfit to dive in accordance with the RSTC Medical Statement and on production by the original document signed by the Doctor. The refund value will be determined by the use of any consumables issued to the student (Training Materials etc) and the amount of notification time given by the student to The Dive Shack prior to the commencement of the registered course commencement.

As per ACCC guidelines, The Dive Shack will not issue a refund if student/s simply change their mind about the course, or other personal circumstances prevent them from attending the course. The Dive Shack will however offer store credit to the value of the purchase price less consumables (Training Materials etc), time and payments made to third parties and subject to a cancellation fee.

As a small family owned and operated business, we will always act in good faith and assess each case individually. The Managing Director reserves the right to use our good faith policy in these circumstances to ensure a positive resolution.

IMPORTANT:
If you have booked onto a course as part of a pair or group and one member can’t make the course date for any reason, the other/rest of the party are still expected to attend. If not, a rescheduling fee of $200 per person will apply to each person.

*Australian Standards recommends students be a minimum 12 years of age to participate in Scuba Diving Courses. PADI Asia Pacific suggests 10 years of age. It is at the sole discretion of the Managing Director to permit a 10-year-old to partake in scuba diving lessons. The 10-year-old will be assessed both physically and mentally competent to partake in the course. A private course will then be structured to suit the individual along with a certified or certifying parent/guardian who will ‘buddy’ with the 10-year-old during and after the course.
